DISRUPTION OF SERVICE / SERVICE INTERRUPTION CLAUSE
Effective Date: August 1, 2026
This Disruption of Service Clause is part of the Terms of Service of the streaming music platform operated by Guitarist James Tomaskovics, a Missouri limited liability company, with its principal address at 2135 E. Independence St. #1022, Springfield, MO 65804, Phone: 1-877-553-5785 (hereinafter “Company,” “we,” “us,” or “our”).
- No Guarantee of Continuous Service.
The Company does not guarantee that the streaming music platform, its website, applications, servers, content delivery networks, or any related services (collectively, the “Service”) will be available at all times, uninterrupted, error-free, or free from delays, suspensions, outages, or other disruptions. Access to and use of the Service may be interrupted, suspended, limited, or terminated temporarily or permanently for any reason, including but not limited to scheduled or unscheduled maintenance, upgrades, technical failures, software or hardware malfunctions, network or internet connectivity issues, third-party service provider failures, acts of God, natural disasters, war, terrorism, civil unrest, government actions, power outages, cyberattacks, force majeure events, or any other cause beyond the Company’s reasonable control. - No Refunds.
In the event of any interruption, suspension, outage, unavailability, degradation, or other disruption of the Service (whether partial or complete, temporary or permanent), the Company shall have no obligation to provide refunds, credits, prorated adjustments, or any other form of monetary compensation to any user, subscriber, or account holder for any subscription fees, one-time payments, or other amounts paid for access to the Service. - No Liability for Damages.
To the maximum extent permitted by applicable law, the Company, its members, managers, officers, employees, agents, affiliates, and licensors shall not be liable to any user or third party for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, loss of goodwill, loss of use, business interruption, or any other losses or damages of any kind, arising out of or related to any disruption, interruption, suspension, or unavailability of the Service, regardless of the cause and whether based in contract, tort (including negligence), strict liability, or any other legal theory, even if the Company has been advised of the possibility of such damages. - User Acknowledgment.
By accessing or using the Service, you expressly acknowledge and agree that:
(a) interruptions and disruptions may occur;
(b) you will not be entitled to any refund or compensation as a result of such events; and
(c) the Company has no duty to notify you in advance of every possible interruption or to restore service within any specific timeframe. - Severability and Governing Law.
If any provision of this Clause is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. This Clause shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of laws principles.
This Clause is effective as of August 1, 2026, and applies to all users of the Service.
